We meet with politicians and law makers, raising concerns proactively.<\/p>\n\n\n\n<p class=\"has-large-font-size\">Below are a selection of submissions we have made.<\/p>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\t<div class=\"accordion\" id=\"accordion\">\r\n \r\n        \t\t\r\n\t\t\t\t\t <div class=\"accordion-item\">\r\n    <h2 class=\"accordion-header\" id=\"accord-ico-consultation-series-on-generative-ai-and-data-protection-chapter-four-2024-head\">\r\n\t\r\n \t\r\n      <button class=\"accordion-button  collapsed\" type=\"button\" data-bs-toggle=\"collapse\" data-bs-target=\"#accord-ico-consultation-series-on-generative-ai-and-data-protection-chapter-four-2024-collapse\" aria-expanded=\"true\" aria-controls=\"#accord-ico-consultation-series-on-generative-ai-and-data-protection-chapter-four-2024-collapse\">\r\n       \tICO consultation series on generative AI and data protection, chapter four 2024      <\/button>\r\n    <\/h2>\r\n    <div id=\"accord-ico-consultation-series-on-generative-ai-and-data-protection-chapter-four-2024-collapse\" class=\"accordion-collapse collapse \" aria-labelledby=\"accord-ico-consultation-series-on-generative-ai-and-data-protection-chapter-four-2024-head\" data-bs-parent=\"#accordion\">\r\n      <div class=\"accordion-body\">\r\n          \t<p>Chapter four of the Information Commissioners Office\u2019s consultations in 2024 focused on &#8216;Engineering individual rights into generative AI models&#8217;. AOI responded emphasising the importance of transparency of input data for AI \u2013 where it has come from, that there are accurate records of such data and that individuals need to be able to assess if that data is accurate. Stakeholders with an interest in generative AI have been invited to respond and help inform the ICO\u2019s positions.<\/p>\n<p>In April the AOI responded to chapter two of this series, which explored how purpose limitation should be applied at different stages in the generative AI lifecycle. Stakeholders with an interest in generative AI have been invited to respond and help inform the ICO\u2019s positions.<\/p>\n<p>The AOI responded in March, expressing concerns from Illustrators that web scraping data for the purpose of AI training is a violation of data protection principles, as it (a) is in direct breach of copyright law; and (b) does not have a valid lawful basis under UK GDPR.<\/p>\n<p>Data protection is essential to safeguard individuals against potential abuses of their personality, intellectual property, and contractual freedoms. It is imperative that these rights be preserved. Questions in the paper were posed around what AI regulators should be doing, should organisations be required to make it clear when they are using AI to ensure adequate transparency, what\u2019s required for confidence and trust in AI technology use and routes to compensate for AI-related harms, amongst others.<\/p>\n<p>AOI responded in June, making the case for illustrators, the massive importance of copyright where images are used for training AI and the requirement for regulators to ensure respect for creators\u2019 rights, plus comment on their proposal for voluntary solutions between AI organisations and creators (rather than legislation).<\/p>\n<p>We emphasised that illustrators support progress in technology but also recognise the need for protections and safeguards where technology is applied. Moving to what is termed \u2018international exhaustion\u2019 could have an impact for illustrators, as goods could be commissioned in any country worldwide which may pay lower fees, and then imported to the UK, potentially minimising commissioning capacity in the UK. longer fit for purpose.<\/p>\n<p>Through the BCC we have underlined the need for licenses to be obtained for creative use\u00a0online, regardless of whether the content is uploaded and \/ or shared directly by the platform or indirectly by users of digital platforms.\u00a0This would ensure that rights holders receive compensation for use of their work.<\/p>\n<p>There is also an imperative need for digital services, not rights holders, to\u00a0have the responsibility\u00a0of\u00a0meaningfully addressing\u00a0piracy, with robust sanctions\u00a0for infringers\u00a0and supervision to create an Union\u00a0<a href=\"https:\/\/ec.europa.eu\/digital-single-market\/en\/copyright\" target=\"_blank\" rel=\"noreferrer noopener\">Copyright Directive<\/a>\u00a0was adopted by the European Council on 15th April 2019.<\/p>\n<p>This Directive on Copyright in the Digital Single Market is an important piece of EU legislation designed to modernise copyright for the digital age, which will help ensure a fairer deal for those working in the creative sector.<\/p>\n<p>The Directive was published on 17 May 2019.\u00a0 By 7 June 2021 all EU member states must have transposed the legislation into their national laws. The Commission is expected to issue guidelines on implementation later in 2019. Several EU member states have already published their considerations on transposition.<\/p>\n<p>The options for the UK are subject to the details of the withdrawal from the European Union, so we may or may not adopt the Directive. If we are still in the EU at the point at which we must implement the directive, it will be achieved via \u201csecondary legislation\u201d (Art. 2 European Communities Act). If we are outside the EU without a deal, it will be a political decision for the UK whether to copy the provisions of the Directive and adopt them as UK law using primary legislation. If we are in transition or in an extension period, it all depends on the arrangements made in the withdrawal agreement and the political intention of Government.<\/p>\n<p>On the Directive\u2019s publication, the\u00a0<a href=\"https:\/\/www.britishcopyright.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">British Copyright Council<\/a> stated that \u2018The result is not perfect, but it is important progress. Following an application in 2018 they withdrew this in the summer as they are waiting to see what happens with the EU\u2019s Copyright Directive and how that might impact an application. This Directive was finalised in 2019.<\/p>\n<p>The Intellectual Property Office (<a href=\"https:\/\/www.gov.uk\/government\/consultations\/application-to-operate-an-ecl-scheme\" target=\"_blank\" rel=\"noreferrer noopener\">IPO<\/a>) asked us to comment through a formal consultation process, which we did for the initial CRA application. They will listen to what we (and others) have to say to inform the final decision on whether the scheme is approved or not if it is reapplied for.<\/p>\n<p><strong>How the process works at present<\/strong><\/p>\n<p>At present, if your work is copied by organisations with a CLA licence you are eligible for royalty payment.<\/p>\n<p>The CLA sells photocopying licences to schools, universities, government and businesses to cover photocopying of limited extracts from copyright-protected books on their premises. The licence fees paid are distributed back to the owners of the copyrighted material \u2013 for visual artists this is done via\u00a0<a href=\"https:\/\/www.dacs.org.uk\/\" target=\"_blank\" rel=\"noreferrer noopener\">DACS<\/a>.<\/p>\n<p>The CLA are authorised to do this for visual artists by DACS. The AOI (and other organisations) in turn authorise DACS. The CLA collects money on behalf of all rights holders, regardless of their membership of a body such as the AOI.<\/p>\n<p><strong><br \/>\nWhat is an Extended Collective Licence?<\/strong><\/p>\n<p>The ECL formalizes the CLA as a licensing body with the ability to collect royalties on behalf of all rights holders, rather than just those who are affiliated to an authorising body.<\/p>\n<p><strong><br \/>\nWhy are we supporting it?<\/strong><\/p>\n<p>The AOI supports a robust and transparent intellectual property regime within the UK to ensure that visual artists can continue to receive just income from their works.<\/p>\n<p>The ECL formalises something that is already in existence, but provides an opportunity to improve it.<\/p>\n<p>Therefore, in our official response to the IPO, we raised several points which we feel should be considered by IPO and CLA. These are:<\/p>\n<p><strong><br \/>\nAwareness of the ECL application<\/strong>: We want to be sure that creators who have rights are informed that an ECL application is happening as some may wish to opt some or all of their works out of it.<\/p>\n<p>We are requesting the CLA to spread their publicity about the scheme across a broad range of communications and explain the scheme in plain English.<\/p>\n<p><strong><br \/>\nOpt Out<\/strong>: The process for\u00a0opt-outing works must be clear, workable\u00a0and\u00a0efficiently operated. This means that the CLA database of works must be accurate, with work easily identifiable under an efficient search system (see \u2018unique identifiers\u2019 below).<\/p>\n<p><strong><br \/>\nEmbedded works<\/strong>: These are works that are part of a larger work, e.g. an illustration in a text book or journal. It should be clear how embedded works will be dealt with. Currently these works are not identifiable via the CLA database, therefore their use may not be identified for payment under the licensing system.<\/p>\n<p><strong><br \/>\nA universal system of unique identifiers<\/strong>: Books and magazines have identifiers in ISBNs and ISSNs but individual works (embedded images, articles etc) do not. We encourage the CLA to work with creator organisations and other interested parties to develop and agree a universal system of unique identifiers for all relevant works (images, books and articles). These could then be embedded in metadata which would allow for more accurate search and identification of use within the CLA database of work.<\/p>\n      <\/div>\r\n    <\/div>\r\n\t<\/div>\r\n\t\r\n\t\r\n        \t\t\r\n\t\t\t\t\t <div class=\"accordion-item\">\r\n    <h2 class=\"accordion-header\" id=\"accord-building-our-industrial-strategy-2018-head\">\r\n\t\r\n \t\r\n      <button class=\"accordion-button  collapsed\" type=\"button\" data-bs-toggle=\"collapse\" data-bs-target=\"#accord-building-our-industrial-strategy-2018-collapse\" aria-expanded=\"true\" aria-controls=\"#accord-building-our-industrial-strategy-2018-collapse\">\r\n       \tBuilding our Industrial Strategy 2018      <\/button>\r\n    <\/h2>\r\n    <div id=\"accord-building-our-industrial-strategy-2018-collapse\" class=\"accordion-collapse collapse \" aria-labelledby=\"accord-building-our-industrial-strategy-2018-head\" data-bs-parent=\"#accordion\">\r\n      <div class=\"accordion-body\">\r\n          \t<p>This is an important review which will result in a modern industrial strategy and economy that works for everyone. There is a specific section considering the Creative Industries. We have fed into the consultation for this, articulating the role of illustration and the creative industries within the UK economy and the need for ongoing support to see this thrive.\u00a0<a href=\"https:\/\/www.gov.uk\/government\/publications\/independent-review-of-the-creative-industries\" target=\"_blank\" rel=\"noreferrer noopener\">You can read the final report\u00a0here.<\/a><\/p>\n<p>In May 2018 the Intellectual Property Office (IPO) responded to the submissions to the Intellectual Property\u00a0<a href=\"https:\/\/www.gov.uk\/government\/consultations\/industrial-strategy-intellectual-property-call-for-views\" target=\"_blank\" rel=\"noreferrer noopener\">Call for Views<\/a>\u00a0on the Industrial Strategy, which in\u00a0November 2017 had asked \u2018What can we do to encourage innovators to do more collaboration and commercialisation, to stimulate knowledge exchange and promote follow- on innovation?\u2019<\/p>\n<p>The Call set out a number of example proposals IPO had received, including the setting up of a Voluntary Intellectual Property Register which IPO proposed may give creators more \u2018legal certainty\u2019. In their 2018 response IPO noted \u2018There was a lack of broad support for the establishment of a Voluntary Register for unregistered IP rights, with many respondents noting the additional legal and administrative burdens such a system could introduce.\u2019<\/p>\n<p>There is no requirement for copyright holders to register their IP in the UK, and AOI had stated that we didn\u2019t believe a voluntary register would benefit creators. Our response had mentioned concerns over the additional time and effort required to register works for individual freelancers or small businesses, combined with the potential cost of registering works, which many individual creators will consider an expense they cannot afford. We also queried how the scheme would legally ascertain the veracity of claims of ownership in registered works \u2013 this could lead to confusion rather than legal certainty.<\/p>\n      <\/div>\r\n    <\/div>\r\n\t<\/div>\r\n\t\r\n\t\r\n        \t\t\r\n\t\t\t\t\t <div class=\"accordion-item\">\r\n    <h2 class=\"accordion-header\" id=\"accord-digital-economy-act-2017-head\">\r\n\t\r\n \t\r\n      <button class=\"accordion-button  collapsed\" type=\"button\" data-bs-toggle=\"collapse\" data-bs-target=\"#accord-digital-economy-act-2017-collapse\" aria-expanded=\"true\" aria-controls=\"#accord-digital-economy-act-2017-collapse\">\r\n       \tDigital Economy Act 2017      <\/button>\r\n    <\/h2>\r\n    <div id=\"accord-digital-economy-act-2017-collapse\" class=\"accordion-collapse collapse \" aria-labelledby=\"accord-digital-economy-act-2017-head\" data-bs-parent=\"#accordion\">\r\n      <div class=\"accordion-body\">\r\n          \t<p>This is a large <a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/2017\/30\/contents\/enacted\">Act<\/a> covering many areas which do not pertain to illustrators \u2013 however there are some technicalities which do \u2013 for example the online intermediary codes. This is where providers are required to take responsibility for content which may be infringing copyright.
